Terms of Service
1. Scope and contracting party
1.1 These terms govern the use of the drilldb application at drilldb.app, operated by MoveNext IT & Sports e.U., Mühlschüttelgasse 61/18, 1210 Vienna, Austria ("we").
1.2 The contracting party for a personal account is the person who creates it. If they create an organization or act for one, they must be authorised to do so. Where a usage contract is concluded with the organization, that person acts as its authorised representative. Invited users each receive their own sign-in and are bound by these terms.
1.3 Paid plans are processed through the payment provider named before purchase. Before a purchase is completed we state which party is the contracting party for providing drilldb, which party handles payment and issues invoices, and which of the payment provider's terms apply. The exact allocation of roles follows the sales model actually used.
1.4 Terms of the user that deviate from these do not apply unless we agree to them in writing.
1.5 Processing on behalf of organizations. For personal data an organization manages in drilldb about its members, the organization is the controller and we are its processor. The data processing agreement in the annex applies between the organization and us. Whoever creates an organization, or accepts these terms as its administrator, concludes that agreement on the organization's behalf.
2. The service
2.1 drilldb is a web application for creating, adapting, searching, sharing and publishing training drills for ball sports and, once available, for planning training sessions, season plans and schedules.
2.2 The scope of the service follows from the current description at drilldb.app/features/ and drilldb.app/pricing/. Features marked "Coming soon" or "Planned" there are not part of the service owed until they are provided.
2.3 Launch prices. A paid subscription that starts on or before 31 December 2027 keeps the prices published when it started for as long as it runs without interruption in the same plan — even if prices for new subscriptions rise later. A subscription that starts afterwards is charged at the prices then current.
2.4 Six free months of Team per team. Every new team gets the Team plan free of charge for six months from the day it is created. No payment details are needed, and there is no automatic switch to a paid plan: when the six months end, you choose a subscription, or the team continues on the free plan (section 4.6).
3. Conclusion of contract and account
3.1 Before you complete registration you can save and retrieve these terms. The usage contract is concluded when you expressly accept these terms, complete registration and confirm your email address. We provide the version in force at conclusion on a durable medium, by email. The privacy policy explains how we process personal data; taking note of it is not consent.
3.2 You sign in with a one-time code sent to your email address or with a Google account. No password is issued.
3.3 You are responsible for ensuring that only you have access to the mailbox you sign in with. If an organization uses a shared mailbox, everyone with access to it has access to the account.
3.4 An account is personal and may not be shared between several people. Only people who are 18 or older may create an account.
4. Plans
4.1 Free includes the library's full functionality, with no limit on the number of items created and no limit on the number of members of an organization. Creating an organization, inviting others, roles and content shared across an organization are included in the free plan.
4.2 Team adds teams, training plans, scheduling, subscribable calendars and usage history. Team is billed per non-archived team, monthly or yearly.
4.3 Pro includes everything in Team plus the AI-assisted features in section 7. Pro is also billed per team and replaces Team for that team.
4.4 Prices. At the launch price Team costs €2.99 per team per month or €24.99 per team per year (regularly €5.99 and €49.99), VAT included. We will state Pro's price before Pro can be bought.
4.5 No paid plan can be bought at present. Team's and Pro's features are still being built; the prices are published so you know what to expect. Sections 4.2 to 4.4 create no obligations before they can be bought.
4.6 Downgrading. When a paid plan or the free period ends, content is neither deleted nor hidden nor locked. You can still read and edit what you created. What is no longer possible is creating new items beyond the free plan, such as new appointments for a team without a plan; archived teams stay fully readable and editable.
5. Right of withdrawal for consumers
5.1 Consumers have a right to withdraw from distance contracts within 14 days without giving reasons (§ 11 FAGG).
5.2 The free plan costs nothing and can be ended at any time (section 6.1). For paid plans you receive the full withdrawal information and the model withdrawal form before purchase; until then no paid contract is concluded (section 4.5).
5.3 For paid contracts concluded online we provide an easily accessible withdrawal function in the application throughout the withdrawal period (§ 13a FAGG), and confirm receipt of a withdrawal by email without delay. Withdrawal is distinct from ordinary cancellation under section 6.2.
6. Term and termination
6.1 The free plan runs indefinitely and can be ended at any time by deleting the account — in the application or by email to privacy@drilldb.app. Section 13.4 describes what deletion does.
6.2 Paid plans run for the billing period chosen at purchase and renew for the same period unless cancelled in time. You can cancel the subscription in the application. During ordering we clearly show the term, the price per billing period, the renewal date and the cancellation deadline. The statutory right of withdrawal within the withdrawal period is unaffected; for it we provide the legally required withdrawal function (section 5.3).
6.3 We may terminate the contract with three months' notice to the end of a billing period, on the free plan to the end of a month, and for good cause with immediate effect, in particular for serious or repeated breaches of section 9. Before terminating for good cause we ask for the breach to be remedied where possible and reasonable.
6.4 Before we end the contract, we provide an export of your content on request (section 13).
7. AI-assisted features (Pro plan)
7.1 The AI-assisted features — in particular drill recommendations for a team, training-session suggestions based on the team's goals, its training history and the coaches' ratings and notes, generating structured drills from a free description, and importing existing collections — are part of the Pro plan. They are not part of the free plan and not part of Team.
7.2 Allowance. Every Pro team comes with a monthly allowance of generations. We state the allowance before purchase.
7.3 Once a billing period's allowance is used up, the AI-assisted features are unavailable until the next period begins. There is no additional charge; no costs arise beyond the agreed fee. All other features are unaffected.
7.4 Results of AI-assisted features are marked as generated and must be checked before use. Mandatory statutory warranty rights are unaffected (section 12.1).
7.5 These features are offered only once they are provided. Before then this section creates no obligations. Before they use an organization's training history, ratings or notes, we will extend the privacy policy and the agreement in the annex.
8. Content, rights and copies
8.1 Rights in content. Copyright and other rights in content remain with their respective holders. Where you upload or create content, you warrant that you hold the necessary rights and may grant the rights of use below. This applies in particular to images in which people are recognisable.
8.2 Use by drilldb. You grant us a simple, territorially unlimited right to store, technically process, display and back up content and to make it available to the users you release it to, as far as operating and providing the chosen features requires. The right lasts as long as the content is stored in the service or must be retained for lawful reasons.
8.3 Assignment in the application. For management within drilldb, an item is assigned to the personal library or to the organization it was created in. If someone leaves an organization, that assignment remains unless the item is deleted. If you delete your account, your personal library and its content are deleted (section 13.4). The assignment does not change copyright or other rights in the content.
8.4 Public content and copies. If you release an item publicly, signed-in users may view it within drilldb, copy it into their own library and edit it there. You grant a simple, royalty-free right of use within drilldb for this. A copy is held in the application as an independent record of the copying organization. If you later make the original private or delete it, a copy already made remains, as far as its continued existence is lawful and it does not infringe third-party rights. Releasing content for drilldb is no general permission to publish it outside the service.
8.5 Share links. If you share an item by link, anyone who has the link can view the shared item without signing in while the link is active. You can revoke the link. Share it only with people who should have access.
8.6 Semantic search. Cross-organization search and recommendation of public content is offered only once the feature is activated and the settings described in the privacy policy, section 7, are provided. Fields and tags internal to an organization are not used for cross-organization search or recommendation as long as other organizations may not see them. Your content is not used to train third-party AI models; the feature is activated only once we have ensured this with the provider contractually and technically.
9. Content rules and prohibited use
Prohibited in particular are: posting illegal content; infringing third-party rights, including copyright, trademark and personality rights; uploading images without the necessary consent of the people shown; content that demeans, threatens or discriminates against people; advertising and spam; posing as another club or person; automated scraping of the library; attempts to circumvent access restrictions; and use that significantly impairs operation.
10. Reporting content, restriction and statement of reasons
10.1 Anyone can report illegal content by email to support@drilldb.app; signed-in users can also use the "Report a problem" function in the application. This is the notice mechanism under Art. 16 of Regulation (EU) 2022/2065. Please state as precisely as possible where the content is (for example the page's address), why you consider it illegal and, where necessary, your name and a contact address, and declare that you believe in good faith that your information and allegations are accurate and complete. We confirm receipt of a report and tell you our decision.
10.2 We review reports carefully and may remove reported content, restrict its visibility or leave it unchanged.
10.3 If we remove content, restrict its visibility or take any other measure against it, we tell the person affected the decision and the main reasons (Art. 17 of Regulation (EU) 2022/2065). The statement describes the measure, the main facts and circumstances, the legal or contractual ground and, where applicable, the use of automated means. We inform about the available complaint and redress routes.
11. Availability
11.1 We aim for stable operation but cannot guarantee uninterrupted availability. Maintenance and faults may cause interruptions; we announce maintenance where possible. Mandatory statutory claims, in particular under the warranty rules for digital services, are unaffected.
11.2 drilldb is developed continuously, and its features may change; we do not remove features of the free plan without notice under section 14.
12. Warranty and liability
12.1 For consumers, the statutory warranty provisions apply, in particular those of the Verbrauchergewährleistungsgesetz (VGG) for digital services.
12.2 Our liability follows the statutory provisions. We are liable without limitation where the law mandatorily requires it, in particular for intent, gross negligence and personal injury. Limitations of liability towards businesses may be agreed separately to the extent permitted by law. No provision of these terms excludes or limits liability where such an exclusion or limitation is not permitted by law.
12.3 Keep your own copy of content that matters to you; you can export it (section 13.1).
13. Export, termination and what happens to data
13.1 You can export your content at any time. Inside the application you can download the drills you created as a file in a common, machine-readable format (JSON). For other content you can request an export from us; we provide it in a common, machine-readable format, usually within one month. Your rights of access and data portability under the GDPR are unaffected.
13.2 When the contract ends, content belonging to an organization stays with that organization.
13.3 An organization with no other members and no content can be deleted by its administrators; any other can only be archived, not deleted, so that its members' content is preserved. Content includes items you cannot see, such as former members' private drafts. An archived organization accepts no new content and no new appointments; its existing content stays readable for its members. The personal library is the exception (section 13.4).
13.4 Deleting your account. Your account deletes your personal data and your personal library with all its content, public items included. Copies other organizations have already made of your public content remain as their own records (section 8.4). Content in clubs stays with the club and shows "Deleted user" instead of your name. Deletion is final; if you want to keep content, copy it into a club first. The privacy policy, section 10, gives the details.
14. Changes to these terms
14.1 We may change these terms where there is an objective reason, in particular a change in the law, a requirement of an authority or court, necessary security measures or a material technical change to the service. We tell you the changes, their reason and their main effects by email at least six weeks before they are due to take effect.
14.2 Changes that alter essential contractual obligations, the price or other central rights and obligations to your disadvantage do not take effect towards consumers merely because you do not object. For those we ask for your express consent, for example when you next sign in. If you do not agree to a change, you can end the contract free of charge before it takes effect; fees paid in advance are refunded pro rata. Statutory rights and mandatory rules on changes to digital services are unaffected.
14.3 Launch prices under section 2.3 are unaffected by price changes.
15. Governing law, jurisdiction and dispute resolution
15.1 Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory provisions of the law of their habitual residence remain unaffected.
15.2 For consumers, § 14 KSchG applies: jurisdiction lies with the court of their domicile, habitual residence or place of employment.
15.3 Towards businesses, jurisdiction lies with the competent court in Vienna.
15.4 We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body (§ 19 AStG).
16. Final provisions
Should individual provisions of these terms be or become invalid, the relevant statutory provisions apply in their place. The remaining provisions stay in force only to the extent the law permits.
Annex — Data processing agreement (Art. 28 GDPR)
A.1 Parties and scope. This agreement applies between the organization using drilldb, as controller, and MoveNext IT & Sports e.U., as processor. It is concluded for the organization when these terms are accepted on its behalf (section 1.5) and applies for as long as the organization exists in drilldb. It does not apply to the personal library; there we are the controller. Between the parties, this agreement takes precedence over the rest of these terms on data protection.
A.2 Subject matter, nature and purpose. We store the processed data and make it available in drilldb so that the organization can manage and work with its members: memberships and roles, invitations, join requests and the emails about them; once available, also teams, scheduling, training history, ratings and notes, and AI-assisted features based on them (section 7).
A.3 Types of data and data subjects. Members' display names and profiles, roles and membership dates, invitees' email addresses, join requests with their message; once available, team assignments, appointments, training history, ratings and notes. The data subjects are the organization's members, invitees and requesters and, once notes are available, people named in them. Special categories of personal data (Art. 9 GDPR) are not intended; the organization ensures notes contain none unless it has a legal basis for them.
A.4 Instructions. We process the data only on the organization's documented instructions. These are this agreement and the use of the application's features by the organization's administrators; further instructions can be given by email to privacy@drilldb.app. Processing required of us by law is excepted; we inform the organization beforehand unless the law prohibits it. If we consider an instruction unlawful, we say so without delay.
A.5 Confidentiality. Only people bound to confidentiality or under a statutory duty of secrecy have access to the processed data. At present that is the owner alone.
A.6 Security of processing (Art. 32 GDPR). In particular: encrypted transmission (TLS) between browser, application and database; the database stored in a European Union region (AWS eu-west-1, Ireland) at our database provider, which encrypts data at rest; row-level access control on every table holding organization data, so that each person reads and changes only what their role in the organization allows; sign-in without passwords, by one-time code or Google; administrative database access by the owner alone; every change to the database schema is checked automatically against the access rules before it is deployed. We keep the measures up to date without lowering the level of protection.
A.7 Sub-processors. The organization authorises the sub-processors named in the privacy policy, section 8. We announce a new or replacement sub-processor to the administrators by email at least four weeks in advance. The organization may object on reasonable data-protection grounds; if we cannot address the objection, it may end the contract before the change. We impose on every sub-processor the same data-protection obligations as agreed here.
A.8 Assistance. We assist the organization with appropriate technical and organisational measures in answering data subjects' requests (Art. 12–22 GDPR) — much of which its administrators can do in the application themselves, such as removing a member or deleting an invitation — and, as far as the information is available to us, with its obligations under Art. 32–36 GDPR. If we receive a request concerning the organization, we pass it on without delay.
A.9 Personal data breaches. We inform the organization without undue delay after becoming aware of a breach affecting the processed data, with the information under Art. 33(3) GDPR as far as it is available to us.
A.10 Deletion and return. Data the organization deletes in the application is deleted. If the organization is deleted or this agreement ends, we delete the remaining processed data unless the law requires its retention; on request we provide it as an export first. Data in our providers' logs expires on their schedule.
A.11 Evidence and audits. We make available to the organization the information needed to demonstrate compliance with these obligations, and allow audits by the organization or an auditor it mandates who is bound to confidentiality — first by written information, on-site audits after reasonable notice.
A.12 Place of processing. Transfers to third countries take place only under the conditions of Chapter V GDPR, as described in the privacy policy, section 8.
